1. Introduction
Welcome to Meshify Studio.
These Terms of Service (“Terms”) govern your access to and use of the Meshify Studio website, services, and related digital offerings.
By accessing our website, submitting a project request, placing an order, or engaging Meshify Studio for services, you acknowledge that you have read, understood, and agree to be bound by these Terms.
If you do not agree with these Terms, please do not use our website or services.
In these Terms, “Meshify Studio,” “we,” “us,” and “our” refer to Meshify Studio. “Client,” “you,” and “your” refer to the individual or entity purchasing or requesting our services.
2. Our Services
Meshify Studio provides custom digital creative and production services, which may include:
- 3D modeling
- Custom 3D-printable STL files
- Product visualization and rendering
- 3D animation
- Motion graphics
- Promotional videos
- 2D graphic design
- Other digital creative services offered through our website
The specific services, deliverables, specifications, timeline, and scope of a project will depend on the requirements agreed upon between Meshify Studio and the Client.
3. Project Requests and Scope
Before beginning a project, Meshify Studio may request information necessary to understand the Client's requirements.
Depending on the project, this may include:
- Project descriptions
- Dimensions and technical specifications
- Reference images
- Existing 3D models or CAD files
- Brand assets
- Product information
- Preferred formats
- Design requirements
- Intended use of the final deliverables
The Client is responsible for providing accurate and sufficiently detailed information.
Any material change to the original requirements after work has commenced may constitute a change in scope and may result in additional charges or an adjusted delivery timeline.
4. Pricing and Quotes
Prices displayed on our website may represent starting prices or estimated pricing for a particular service.
Because custom projects vary significantly in complexity, the final price may depend on factors including:
- Project complexity
- Required level of detail
- Number of assets or deliverables
- Technical requirements
- Number of revisions
- Animation duration
- Rendering requirements
- Project timeline
- Additional services requested
A final project price may therefore differ from any starting price displayed on our website.
Where applicable, Meshify Studio will provide a quote or project proposal before beginning the relevant work.
A quote may have an expiration period and may be subject to change if the project requirements change.
5. Payments
Payment terms will be communicated during the project or ordering process.
Depending on the project, Meshify Studio may require full payment, a deposit, milestone payment, or another agreed payment arrangement before or during the project.
The Client agrees to provide accurate billing and payment information and to pay all agreed amounts when due.
Work may be paused or withheld if required payments are not received within the applicable payment period.
6. Project Commencement
A project is considered to have commenced when Meshify Studio begins substantive work on the project after receiving the required information, approval, deposit, payment, or other agreed authorization.
Because custom work involves time and resources dedicated specifically to the Client, cancellation and refund eligibility after work has commenced is governed by our Return & Refund Policy.
7. Revisions and Approvals
Where revisions are included in a project, they must remain reasonably within the original project scope.
A revision may include reasonable adjustments to an existing concept or deliverable.
Requests that introduce a substantially different concept, new requirements, additional assets, significant redesigns, or other work outside the agreed scope may be treated as additional work and may incur additional charges.
The Client is responsible for reviewing project previews, proofs, drafts, or other approval materials provided by Meshify Studio.
Once a Client approves a design, concept, render, animation, or other project stage, subsequent changes may be considered additional work.
8. Project Timelines
Meshify Studio will make reasonable efforts to meet agreed or estimated delivery timelines.
However, delivery dates may change due to:
- Changes in project scope
- Delayed client feedback
- Missing information or files
- Additional revision requests
- Technical issues
- Third-party service interruptions
- Circumstances outside our reasonable control
Unless expressly agreed otherwise in writing, estimated delivery dates are not guaranteed deadlines.
9. Client Responsibilities
The Client agrees to:
- Provide accurate project information
- Provide required files and references in a timely manner
- Respond to reasonable requests for clarification or approval
- Review deliverables within a reasonable timeframe
- Ensure that materials supplied to Meshify Studio may legally be used for the requested project
Meshify Studio is not responsible for delays or problems caused by inaccurate, incomplete, misleading, or late information provided by the Client.
10. Client-Provided Materials
The Client may provide images, logos, artwork, 3D models, CAD files, product information, documents, or other materials for use in a project.
The Client represents that they have the necessary rights, licenses, permissions, or authorization to provide and use those materials.
The Client remains responsible for any claims arising from materials that they provide to Meshify Studio and that infringe the rights of another person or entity.
11. Intellectual Property
Unless otherwise agreed in writing, ownership and usage rights relating to a project may depend on the nature of the service, the deliverables provided, and the applicable project agreement.
Payment for a project does not automatically transfer ownership of every underlying asset, tool, source file, template, workflow, software component, or pre-existing material used by Meshify Studio to create the deliverables.
Meshify Studio retains ownership of its pre-existing intellectual property, proprietary methods, tools, templates, processes, and reusable assets.
Where a project specifically includes transfer of ownership or specific usage rights, those rights will be determined by the applicable project agreement or written confirmation.
12. Digital Files and Source Files
Final deliverables may be provided in the file formats agreed upon for the project.
Editable source files, working files, project files, raw files, scene files, layered files, or other production materials are not automatically included unless specifically stated in the project agreement.
Meshify Studio may retain working files and production assets for operational, archival, or legal purposes, subject to applicable confidentiality obligations.
13. 3D-Printable Files and STL Deliverables
Where Meshify Studio provides STL files or other 3D-printable files, the Client is responsible for confirming that the files are suitable for their intended printer, material, scale, manufacturing process, and application unless specific testing or manufacturing services have been expressly included.
3D printing results may vary depending on hardware, materials, slicer settings, printer calibration, orientation, supports, post-processing, and other factors outside Meshify Studio's control.
Unless expressly agreed otherwise, providing a digital 3D-printable file does not constitute a guarantee of a particular physical printing result.
14. Prohibited Use
You may not use our website or services to:
- Violate applicable laws or regulations
- Infringe intellectual-property, privacy, publicity, or other rights of another person or entity
- Submit materials that you do not have the right to use
- Attempt to gain unauthorized access to our systems
- Introduce malicious code or harmful software
- Interfere with the operation or security of our website or services
- Use our services for unlawful or fraudulent purposes
Meshify Studio reserves the right to refuse or discontinue a project that it reasonably believes violates these Terms or applicable law.
15. Confidentiality
We understand that projects may involve confidential or commercially sensitive information.
Meshify Studio will take reasonable measures to protect confidential information provided by Clients and will use such information primarily for purposes necessary to provide the requested services.
Where an NDA or separate confidentiality agreement has been executed, its terms will govern the treatment of information covered by that agreement.
16. Portfolio and Marketing Use
Unless otherwise agreed in writing, Meshify Studio may request or use completed work for portfolio, website, social media, marketing, or promotional purposes.
However, where a Client has expressly requested confidentiality or where a project is subject to confidentiality obligations, Meshify Studio will respect those applicable restrictions.
If a Client requires that a completed project remain confidential or not be publicly displayed, this should be communicated before or during the project so appropriate arrangements can be made.
17. Third-Party Services
Meshify Studio may rely on third-party platforms or services for certain business functions, such as payment processing, hosting, cloud storage, communication, analytics, file delivery, or other operational services.
Third-party services may be subject to their own terms and policies.
Meshify Studio is not responsible for interruptions, failures, or policies of third-party services that are outside our reasonable control.
18. Website Content
We make reasonable efforts to keep the information on our website accurate and current.
However, website content, service descriptions, examples, starting prices, availability, estimated timelines, and other information may be updated or changed without prior notice.
Images and examples displayed on our website may represent previous work, concepts, or demonstrations and may not represent the exact scope or result of a future project.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, our website and services are provided on an “as available” and “as reasonably provided” basis.
We do not guarantee that:
- The website will always be available or uninterrupted
- The website will be completely error-free
- Every service will be suitable for every intended purpose
- A digital deliverable will produce a particular result in every third-party application, printer, platform, or environment
Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
20. Limitation of Liability
To the maximum extent permitted by applicable law, Meshify Studio will not be liable for indirect, incidental, consequential, special, or punitive damages arising from the use of our website or services.
Where permitted by law, Meshify Studio's total liability relating to a particular project or service will not exceed the amount actually paid by the Client to Meshify Studio for the specific service giving rise to the claim.
This limitation does not apply where liability cannot legally be limited or excluded.
21. Force Majeure
Meshify Studio will not be responsible for failure or delay in performing its obligations where the failure or delay results from circumstances beyond our reasonable control.
Such circumstances may include major technical failures, internet or infrastructure outages, natural disasters, government actions, labor disruptions, cyber incidents, or other events that could not reasonably have been prevented or controlled.
22. Suspension or Termination
Meshify Studio may suspend or terminate access to its website or services where reasonably necessary, including in cases involving:
- Non-payment
- Material breach of these Terms
- Fraudulent activity
- Abuse of our services
- Unlawful activity
- Unauthorized use of our systems or intellectual property
Termination does not automatically eliminate obligations that arose before termination.
23. Privacy
Your use of our website and services is also subject to our Privacy Policy, which explains how Meshify Studio collects, uses, protects, and handles personal information.
24. Refunds and Cancellations
Project cancellations and refund requests are governed by our Return & Refund Policy.
Because Meshify Studio primarily provides customized digital services, the availability of a refund may depend on whether work has commenced, the amount of work completed, the nature of the deliverables, and applicable law.
25. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable to the legal entity operating Meshify Studio, unless otherwise required by applicable law.
Any dispute arising in connection with these Terms or our services shall be handled in accordance with the applicable legal and jurisdictional requirements governing the relevant transaction.
26. Changes to These Terms
Meshify Studio may update these Terms from time to time to reflect changes to our services, business practices, technology, or legal requirements.
When changes are made, the updated version will be posted on our website with a revised Effective Date.
Your continued use of our website or services after the updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.
27. Severability
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, the remaining provisions will continue to remain in effect to the extent permitted by applicable law.
28. Entire Agreement
These Terms, together with any applicable project agreement, quote, proposal, order confirmation, Privacy Policy, and other written terms expressly incorporated into a transaction, constitute the agreement governing your use of the relevant Meshify Studio services.
If there is a conflict between these Terms and a specific written project agreement, the specific project agreement will control with respect to that project.
